This new provision, part of the <a href=\"https:\/\/www.boe.es\/eli\/es\/lo\/2025\/01\/02\/1\">Organic Law 1\/2025, measures on the efficiency of the Public Justice Service<\/a>, introduced significant changes for people considering divorce and for legal professionals. In this article, we explore what this reform entails, the types of divorce it affects, and how to proceed.  <\/p>\n\n<h2 class=\"wp-block-heading has-text-color has-medium-font-size\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong style=\"font-weight: bold;\"><strong>What Does Mandatory Mediation Involve?<\/strong><\/strong><\/h2>\n\n<p>With the entry into force of <a href=\"https:\/\/www.boe.es\/eli\/es\/lo\/2025\/01\/02\/1\">Organic Law 1\/2025<\/a>, before filing a contested divorce petition, couples must go through a mediation process. This means that disputes related to the divorce must first attempt to be resolved through dialogue and negotiation, with the help of a specialised mediator. Mediation seeks to encourage out-of-court agreements that avoid lengthy court proceedings.  <\/p>\n\n<p>According to <a href=\"https:\/\/www.boe.es\/eli\/es\/lo\/2025\/01\/02\/1\"><strong>Article 1<\/strong><\/a><a href=\"https:\/\/www.boe.es\/eli\/es\/lo\/2025\/01\/02\/1\"> of Organic Law 1\/2025<\/a>: <em>\u201cBefore filing a contested divorce petition, the parties must attend a mediation or conciliation procedure, the aim of which is to reach an out-of-court agreement. This mediation will be conducted by an accredited mediator.\u201d<\/em><\/p>\n\n<p>This excerpt reflects the basic structure of the new mandatory mediation procedure, making it clear that it is a prerequisite to initiating litigation, except in certain cases.<\/p>\n\n<p>The implementation of mandatory mediation in contested divorces pursues several fundamental objectives. First, a <strong>significant reduction in the courts\u2019 workload<\/strong> is expected, allowing them to focus on cases that truly require contentious judicial intervention. In addition, mediation seeks to <strong>promote more personalised solutions tailored to the specific needs of each family<\/strong>, unlike court rulings, which are often more standardised.  <\/p>\n\n<p>Finally, a <strong>reduction in emotional and financial costs<\/strong> for the parties involved is anticipated, by avoiding lengthy and costly court proceedings. Although Organic Law 1\/2025 is recent, experience in other countries with similar systems suggests a positive impact in these areas. <\/p>\n\n<p>The mediation process usually begins with an <strong>information session<\/strong> with an accredited mediator, where the principles and operation of mediation are explained. After this session, if both parties agree to continue, the <strong>mediation sessions<\/strong> themselves are scheduled.  <\/p>\n\n<p>The schedule and location of these sessions are agreed between the parties and the mediator. The length of each session and the total number of sessions required vary depending on the complexity of the case. <\/p>\n\n<p>It is important to clarify that, according to <a href=\"https:\/\/www.boe.es\/eli\/es\/lo\/2025\/01\/02\/1\">Article 1 of Organic Law 1\/2025<\/a>, <strong>the obligation lies in<em> &#8220;attending a mediation or conciliation procedure&#8221;<\/em><\/strong><em>,<\/em> which entails attending this initial information phase. An unjustified refusal to participate in mediation could have procedural consequences, although this remains to be defined in judicial practice. <\/p>\n\n<p>Mediation in contested divorce cases must be conducted by an <strong>accredited mediator<\/strong>, as required by Article 1 of Organic Law 1\/2025. To obtain this accreditation, professionals typically need specific training in family mediation and must be registered in an official register of mediators. The mediator plays a fundamental role as a <strong>facilitator of communication and negotiation<\/strong> between the parties, ensuring an impartial and confidential process. Their role is not to impose solutions, but to help the parties find mutually acceptable agreements.   <\/p>\n\n<h2 class=\"wp-block-heading has-text-color has-medium-font-size\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong style=\"font-weight: bold;\"><strong style=\"font-weight: bold;\"><strong style=\"font-weight: bold;\">Exceptions to mandatory mediation<\/strong><\/strong><\/strong><\/h2>\n\n<p>Although mediation is mandatory in most cases, there are certain exceptions in which it will not apply, allowing the parties to go directly to court. These exceptions are crucial to protect the rights and safety of those involved. The law provides that mediation will not be mandatory in the following cases:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Gender-based violence:<\/strong> If one spouse has been a victim of gender-based violence, whether physical, psychological or emotional, mandatory mediation will not apply. In these cases, victims have the right to access the courts immediately without having to go through the mediation process. The law recognises that a violent environment prevents the victim of abuse from being able to participate freely and on an equal footing in a mediation process.  <br\/><br\/><\/li>\n\n\n\n<li><strong>Abuse:<\/strong> Similar to cases of gender-based violence, if there is physical or psychological abuse between the parties, mediation is inappropriate. Abuse, which may occur in a context of coercion or intimidation, creates a power imbalance that prevents equitable and fair dialogue during the mediation process. <br\/><br\/><\/li>\n\n\n\n<li><strong>Unequal ability to participate:<\/strong> In situations where one party cannot participate on an equal footing in the mediation process, whether for physical, psychological or any other reasons, the parties are also exempt from the obligation to mediate. For example, in cases of mental incapacity or emotional dependence, the person who cannot express themselves freely may be excluded from the mediation process. <\/li>\n<\/ul>\n\n<p><\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Urgent situations:<\/strong> If the situation requires immediate intervention, such as cases where there are risks to minors or an imminent danger to one of the spouses, mediation may also be bypassed. Court proceedings become the most appropriate route to make urgent decisions on custody, interim measures or protection. <\/li>\n<\/ul>\n\n<p>While Organic Law 1\/2025 establishes mediation as a mandatory prior step, it is crucial to clarify whether there are <strong>other exceptions to this rule<\/strong>. It is foreseeable that situations will be contemplated where mediation is not appropriate. Implementing regulations or future judicial interpretation will need to clearly specify these possible exceptions.  <\/p>\n\n<p>Ultimately, the exceptions are designed to ensure that people in <strong>vulnerable situations<\/strong> are not forced to participate in a mediation process that could worsen their situation. These scenarios are clearly set out in the law to protect both victims of violence and those who are at a disadvantage during the separation or divorce process. <\/p>\n\n<p>In the words of Organic Law 1\/2025:<em>\u201cThe obligation of prior mediation will not apply in cases where the existence of gender-based violence, abuse, or where one of the parties cannot participate on an equal footing in the process is proven.\u201d<\/em><\/p>\n\n<p>These exceptions ensure that, although mediation is mandatory in most cases, judicial proceedings remain accessible and appropriate for those in situations where mediation is not the safest or most viable option.<\/p>\n\n<h2 class=\"wp-block-heading has-text-color has-medium-font-size\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong style=\"font-weight: bold;\"><strong style=\"font-weight: bold;\"><strong style=\"font-weight: bold;\"><strong>Types of divorce affected by this reform<\/strong><\/strong><\/strong><\/strong><\/h2>\n\n<p>The reform mainly affects contested divorces, in which the parties are unable to agree on key aspects of the separation, such as child custody, child support, division of assets and other financial matters. However, divorces by mutual agreement, where both parties reach a consensus on the terms of the divorce, are not subject to mandatory mediation. In these cases, the process remains straightforward and quick.  <\/p>\n\n<p>It is important to note that the mediation process will only be a preliminary stage. If the parties are unable to reach an agreement during mediation, they may file the contested divorce petition with the competent court. <\/p>\n\n<h2 class=\"wp-block-heading has-text-color has-medium-font-size\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong style=\"font-weight: bold;\"><strong style=\"font-weight: bold;\"><strong style=\"font-weight: bold;\"><strong>Types of divorce affected by this reform<\/strong><\/strong><\/strong><\/strong><\/h2>\n\n<p>Mediation has several advantages for both spouses and the professionals advising them:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Less burden on the courts:<\/strong> By resolving disputes outside the courts, congestion in the courts is reduced.<\/li>\n\n\n\n<li><strong>Cost reduction:<\/strong> Although mediation has an associated cost, it is usually much lower than that of contentious court proceedings.<\/li>\n\n\n\n<li><strong>Greater control over the process:<\/strong> The parties have the opportunity to reach an agreement that better suits their needs, without a judge imposing a decision.<\/li>\n\n\n\n<li><strong>Faster resolution:<\/strong> Mediation can be much quicker than traditional court proceedings.<\/li>\n<\/ul>\n\n<p>One of the key aspects of mediation is understanding how costs and the duration of the process are managed.<\/p>\n\n<p>Under the new law, the duration of mediation will depend on the complexity of the case and the parties\u2019 availability to reach an agreement. However, the law provides that the process must be relatively quick and effective so as not to unnecessarily prolong the conflict. <\/p>\n\n<p>As for cost, the process will be free for those entitled to legal aid, which may include people with limited financial resources, among other criteria. For everyone else, the parties must bear the costs arising from mediation. These costs will be determined by the mediator or the mediation centre responsible for the process.  <\/p>\n\n<p>It is important to note that, although the cost of mediation varies depending on the mediator and the centre, it is usually considerably more economical than the expenses associated with full court litigation.<\/p>\n\n<p>As the law provides in Article 3 of Organic Law 1\/2025: <em>\u201cThe mediation process will be free for those entitled to legal aid. In the case of others, the parties must assume the costs arising from mediation, the amount of which will be determined by the mediator or the mediation centre.\u201d<\/em><\/p>\n\n<p>This financial aspect aims to make mediation accessible to a greater number of people, promoting its use as a more affordable and less traumatic alternative to court proceedings.<\/p>\n\n<p>As regards <strong>mediation costs<\/strong>, these are usually shared by both parties, although this may be agreed otherwise. It is important to find out about the mediator\u2019s fees and whether there are <strong>legal aid<\/strong> mechanisms that cover mediation expenses for people with limited resources. <\/p>\n\n<h2 class=\"wp-block-heading has-text-color has-medium-font-size\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong style=\"font-weight: bold;\"><strong style=\"font-weight: bold;\"><strong style=\"font-weight: bold;\"><strong>How to start the process?<\/strong><\/strong><\/strong><\/strong><\/h2>\n\n<p>From now on, before initiating a contested divorce petition, it will be mandatory to attend at least one mediation session. Although it may seem uncomfortable or even unnecessary, this step has become a prerequisite to begin the formalities of a contested divorce.<\/p>\n\n<p>As we said at the beginning, mediation aims to offer the parties an opportunity to engage in structured and controlled dialogue, facilitated by a professional mediator, in order to reach an agreement on the terms of the separation. This initial meeting not only seeks to address the emotional aspects that may arise in a separation, but also to deal practically with the most important issues:<strong> child custody, division of assets, child support, and other financial and property matters.<\/strong> <\/p>\n\n<p>Although it is not a process that guarantees resolution of the conflict, it is a space designed to explore solutions that benefit both parties, avoiding the wear and tear of prolonged court proceedings. For couples facing this new requirement, it is advisable to <strong>prepare for mediation<\/strong> by gathering all relevant information on the matters to be addressed (child custody, distribution of assets, child support, etc.). It is helpful to <strong>attend the information session with an open attitude to dialogue and negotiation<\/strong>.  <\/p>\n\n<p>If, after this first session, <strong>no agreement is reached<\/strong>, do not worry: you will be able to proceed with the court process. Mediation does not force you to concede or accept terms you do not consider fair.
