{"id":11597,"date":"2023-09-10T12:00:00","date_gmt":"2023-09-10T10:00:00","guid":{"rendered":"https:\/\/www.in-diem.com\/abogados\/uncategorized\/expungement-of-police-records"},"modified":"2026-03-13T14:28:51","modified_gmt":"2026-03-13T13:28:51","slug":"expungement-of-police-records","status":"publish","type":"post","link":"https:\/\/www.in-diem.com\/en\/abogados\/criminal\/expungement-of-police-records","title":{"rendered":"Expungement of Police Records"},"content":{"rendered":"\n<h4 class=\"wp-block-heading has-text-color\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong>1.-<\/strong> <strong>What are police records?<\/strong><\/h4>\n\n<p>Police records are personal data processed by the competent authority, in accordance with <em><a href=\"https:\/\/www.boe.es\/eli\/es\/lo\/2021\/05\/26\/7\">Organic Law 7\/2021, of May 26<\/a>, on the protection of personal data (LOPDP)<\/em>, which are stored in a file of persons of police interest (PERPOL file) and are obtained without the consent of the affected person.<\/p>\n\n<p>Unfavorable police records derive from acts classified in the Penal Code as crimes or misdemeanors, or from administrative acts that have led to the initiation of proceedings (by FCSE) and their subsequent referral to Judicial or Administrative Authorities.<\/p>\n\n<h4 class=\"wp-block-heading has-text-color\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong>2.- Can police records be expunged?<\/strong><\/h4>\n\n<p><strong>The answer is yes<\/strong>. The expungement or suppression of personal data held in police files can be agreed upon ex officio or at the request of the interested party.
