You may think there is nothing you can do, that the decision is final and that you have no choice but to accept it.  <\/p>\n\n<p class=\"has-vivid-cyan-blue-color has-text-color has-link-color has-medium-font-size wp-elements-dda35bfff1a38e4c97f04f6e3fea9637\"><strong>But that is not true.<\/strong><\/p>\n\n<p>Even after a refusal of entry at the border, even after you have been returned to your country, <strong>there are legal avenues to challenge that decision<\/strong>, have it annulled, remove entry bans from your record, and protect your immigration future.<\/p>\n\n<p>This article explains what legal remedies are available to you after an airport detention or refusal of entry, when and how to file them, and why the involvement of a specialist lawyer makes the difference between a successful challenge and an appeal that will be dismissed.<\/p>\n\n<p>At <strong>IN DIEM Abogados<\/strong>, we have been handling these situations for years, defending people refused entry at Spanish and European airports. And all administrative acts in Spain can be challenged if you consider them unlawful, unfair, or adopted in breach of your rights. <\/p>\n\n<p>This is guaranteed by the <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1978-31229\">Spanish Constitution<\/a>, <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-10565\">Law 39\/2015 on the Common Administrative Procedure<\/a>, the <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1998-16718\">Law on the Contentious-Administrative Jurisdiction<\/a>, and the <a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2016\/399\/oj\/eng\">Schengen Borders Code<\/a><\/p>\n\n<p>At <strong>IN DIEM<\/strong>, we analyse each refusal of entry as an administrative act subject to thorough legal scrutiny. Administrative appeal (administrative route):<\/strong> The first appeal to the administration itself.<\/p>\n\n<p><strong>2. Contentious-administrative appeal (judicial route):<\/strong> Filed before the courts that review the legality of administrative decisions.<\/p>\n\n<p><strong>3. Habeas corpus:<\/strong> An urgent judicial action only when there is unlawful deprivation of liberty.<\/p>\n\n<h2 class=\"wp-block-heading has-text-color has-medium-font-size\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong>Administrative appeal: the first opportunity<\/strong><\/h2>\n\n<p>The administrative appeal is the first step in the administrative route to challenge a refusal of entry. It is filed with the <strong>hierarchical superior<\/strong> of the authority that made the decision. <\/p>\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>Deadline and filing<\/strong><\/h3>\n\n<p><strong>Deadline:<\/strong> One month from the date you were notified of the refusal-of-entry decision. This deadline is <strong>non-extendable<\/strong>: if you miss it, you lose this avenue. <\/p>\n\n<p><strong>Where is it filed<\/strong>? Usually with the <strong>Government Sub-delegation of the province<\/strong> where the airport is located (for example, the Government Sub-delegation in Madrid for Barajas). Your lawyer knows exactly which body it must be filed with depending on your specific case.  <\/p>\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>What is argued<\/strong>?<\/h3>\n\n<p>The administrative appeal is not a simple complaint letter. This is also non-extendable. <\/p>\n\n<p><strong>Where is it filed<\/strong>? Usually before the <strong>Contentious-Administrative Court of the place where the airport is located<\/strong>. Correctly determining territorial jurisdiction is crucial to avoid inadmissibility.  <\/p>\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>What is challenged<\/strong>?<\/h3>\n\n<p>The judge reviews whether the administrative decision is <strong>lawful<\/strong>. Grounds for challenge include: <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Procedural defects:<\/strong> Irregularities that make it voidable<\/li>\n\n\n\n<li><strong>Formal defects:<\/strong> Defects in the decision that invalidate it<\/li>\n\n\n\n<li><strong>Substantive defects:<\/strong> The decision is contrary to substantive law<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading has-vivid-cyan-blue-color has-text-color has-link-color has-medium-font-size wp-elements-3e9d868f3aa8faa2cb5decda2275b208\"><strong>Interim measures: a crucial tool<\/strong><\/h3>\n\n<p>You may request that the judge <strong>suspend the effects of the refusal of entry<\/strong> while the appeal is decided:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Suspend an entry ban<\/li>\n\n\n\n<li>Prevent a return from being enforced<\/li>\n\n\n\n<li>Suspend any harmful effect<\/li>\n<\/ul>\n\n<p>For them to be granted, the judge must find that your arguments are serious and that you will suffer harm that is difficult to remedy if enforcement is not suspended.<\/p>\n\n<p>Obtaining interim measures requires solid legal argument supported by documentation and case law. You may appeal. <\/p>\n\n<p><strong>Partially upheld:<\/strong> It is annulled due to formal defects, requiring the administration to roll back the procedure, but without guaranteeing a different outcome.<\/p>\n\n<h3 class=\"wp-block-heading has-vivid-cyan-blue-color has-text-color has-link-color has-medium-font-size wp-elements-bd52e7155b8a2f1eedb905574c74e71a\"><strong>Why do you need a specialist lawyer and court agent<\/strong>?<\/h3>\n\n<p>The contentious-administrative appeal requires:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Mandatory representation by a court agent<\/li>\n\n\n\n<li>Technical knowledge of administrative and immigration law<\/li>\n\n\n\n<li>Experience drafting contentious-administrative claims<\/li>\n\n\n\n<li>Ability to analyse the administrative file (it may run to hundreds of pages)<\/li>\n\n\n\n<li>Knowledge of case law of the Supreme Court and the Court of Justice of the European Union<\/li>\n<\/ul>\n\n<p>A non-specialist lawyer will face enormous difficulties in handling this process with any guarantee of success.<\/p>\n\n<h2 class=\"wp-block-heading has-text-color has-medium-font-size\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong>Habeas corpus: when your liberty is unlawfully at stake<\/strong><\/h2>\n\n<p>Habeas corpus is an urgent judicial procedure that can be activated when a person is <strong>unlawfully deprived of liberty<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>When does it apply<\/strong>?<\/h3>\n\n<p>Habeas corpus does not challenge the refusal of entry; rather, it <strong>reviews whether your deprivation of liberty is lawful<\/strong>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Detention at the airport without legal grounds<\/li>\n\n\n\n<li>Excessive time in the inadmissibles room (more than 72 hours without a decision or judicial oversight)<\/li>\n\n\n\n<li>Detention in a CIE without judicial authorisation<\/li>\n\n\n\n<li>Violation of safeguards during detention<\/li>\n\n\n\n<li>Extension of detention beyond the authorised period<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>Urgent processing<\/strong><\/h3>\n\n<p>It is filed with the <strong>duty Investigating Court<\/strong>. If it is lawful, it is confirmed. <\/p>\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>Habeas corpus as a strategic tool<\/strong><\/h3>\n\n<p>Although it does not resolve the merits of your immigration situation, it is powerful when used correctly:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Provides immediate judicial oversight<\/li>\n\n\n\n<li>Documents irregularities useful for subsequent appeals<\/li>\n\n\n\n<li>Puts pressure on the administration to act properly<\/li>\n\n\n\n<li>Can buy valuable time<\/li>\n<\/ul>\n\n<p><strong><strong><strong>\u2714<\/strong><\/strong>  <em>Important<\/em>:<\/strong> It only reviews the legality of the deprivation of liberty, not the refusal of entry.
