{"id":21597,"date":"2024-07-25T09:31:31","date_gmt":"2024-07-25T07:31:31","guid":{"rendered":"https:\/\/www.in-diem.com\/is-exercising-the-right-to-remain-silent-an-indication-of-guilt\/"},"modified":"2026-08-12T14:42:27","modified_gmt":"2026-08-12T12:42:27","slug":"is-exercising-the-right-to-remain-silent-an-indication-of-guilt","status":"publish","type":"post","link":"https:\/\/www.in-diem.com\/en\/is-exercising-the-right-to-remain-silent-an-indication-of-guilt\/","title":{"rendered":"Is exercising the right to remain silent an indication of guilt?"},"content":{"rendered":"<div class=\"vgblk-rw-wrapper limit-wrapper\">\n<p class=\"wp-block-paragraph\">The case of <strong>Bego\u00f1a G\u00f3mez Fern\u00e1ndez<\/strong> has generated significant social and political repercussions in Spain due to accusations of influence peddling and facilitating public contracts worth 10 million euros to companies with which she had friendly relations, especially those associated with businessman <strong>Juan Carlos Barrab\u00e9s<\/strong>. It is alleged that she used her position as the wife of <strong>Pedro S\u00e1nchez P\u00e9rez-Castej\u00f3n, President of the Government of Spain<\/strong>, for these purposes. G\u00f3mez Fern\u00e1ndez exercised her right not to testify on two occasions, while her lawyer asserts that she has nothing to hide.  <\/p>\n\n<p class=\"wp-block-paragraph\">This article analyzes the assessment of the accused&#8217;s silence or refusal to testify during the investigation and oral trial from a <strong>jurisprudential perspective<\/strong>, which is crucial for establishing an adequate defense strategy. A relevant example is <strong>Madrid Provincial Court Judgment no. 100\/2014, of February 6<\/strong>, supported by various resolutions: <\/p>\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong> Constitutional Court Judgment No. 61\/2005<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">It is logical and reasonable to deduce an indication of guilt from the passive conduct of the accused, but this deduction must be made within the context of a conviction formed by evaluating all available evidence.<\/p>\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong> Constitutional Court Judgment No. 202\/2000<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">It is considered that, in the presence of certain objective evidence presented by the prosecution, the accused&#8217;s lack of explanations due to exercising the right to remain silent may be used by the judge to support a conviction. However, this conviction cannot be based solely on the fact that the accused chose to remain silent. <\/p>\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong>Supreme Court Criminal Chamber Judgment 21-10-2004 <\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">It is recognized that the accused&#8217;s silence in the oral trial, by refusing to testify, is a legitimate right and part of their right to defense, and therefore this silence cannot be considered as incriminating evidence. However, in cases where the prosecution has presented sufficient evidence requiring an explanation from the accused, their silence is not taken as evidence against them, but it can be considered an element when evaluating the evidence presented. <\/p>\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#0029a4;font-style:normal;font-weight:400\"><strong>Judgments of the European Court of Human Rights dated February 8, 1996 (Murray v. United Kingdom), and March 20, 2001 (Telfner v. Austria)<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">It is considered that the Court may draw conclusions from the accused&#8217;s silence when, given the evidence presented by the prosecution, the only logical conclusion is that the accused has no explanation for the case. The Supreme Court, for its part, has affirmed that the assessment of the accused&#8217;s silence must be complementary, acting as a final argument on the existence of incriminating evidence. El derecho a guardar silencio forma parte del derecho de defensa reconocido en el art\u00edculo 24.2 de la Constituci\u00f3n Espa\u00f1ola. Ninguna persona investigada o acusada est\u00e1 obligada a declarar contra s\u00ed misma ni a confesarse culpable.<\/p><\/div><\/details><details class=\"indiem-faq-item\"><summary>\u00bfGuardar silencio puede considerarse una prueba de culpabilidad?<\/summary><div class=\"indiem-faq-content\"><p>No. El silencio del investigado o acusado no puede ser considerado, por s\u00ed solo, una prueba de cargo ni un indicio suficiente de culpabilidad. La jurisprudencia admite que el silencio pueda valorarse de forma complementaria cuando existen pruebas de cargo relevantes que requerir\u00edan una explicaci\u00f3n razonable. En ning\u00fan caso puede sustituir la necesidad de prueba suficiente.<\/p><\/div><\/details><details class=\"indiem-faq-item\"><summary>\u00bfQu\u00e9 diferencia hay entre guardar silencio y admitir los hechos?<\/summary><div class=\"indiem-faq-content\"><p>Guardar silencio no equivale a reconocer los hechos ni a aceptar la tesis de la acusaci\u00f3n. Es una manifestaci\u00f3n leg\u00edtima del derecho de defensa. La culpabilidad debe probarse por la acusaci\u00f3n, no deducirse autom\u00e1ticamente de la falta de declaraci\u00f3n.<\/p><\/div><\/details><details class=\"indiem-faq-item\"><summary>\u00bfPuede una condena basarse \u00fanicamente en el silencio?<\/summary><div class=\"indiem-faq-content\"><p>No. Una condena penal no puede fundarse exclusivamente en que el acusado haya decidido no declarar. Deben existir otras pruebas de cargo que acrediten los hechos y la participaci\u00f3n de la persona acusada.<\/p><\/div><\/details><details class=\"indiem-faq-item\"><summary>\u00bfQu\u00e9 ha dicho el Tribunal Constitucional sobre el silencio del acusado?<\/summary><div class=\"indiem-faq-content\"><p>El Tribunal Constitucional ha se\u00f1alado que el silencio puede ser valorado dentro del conjunto de la prueba, pero no puede operar como prueba aut\u00f3noma de culpabilidad. Su valoraci\u00f3n debe realizarse siempre con respeto al derecho de defensa y a la presunci\u00f3n de inocencia.<\/p><\/div><\/details><details class=\"indiem-faq-item\"><summary>\u00bfQu\u00e9 criterio sigue el Tribunal Supremo?<\/summary><div class=\"indiem-faq-content\"><p>El Tribunal Supremo ha admitido que el silencio pueda tener relevancia argumentativa cuando la acusaci\u00f3n ha aportado pruebas s\u00f3lidas que no reciben explicaci\u00f3n alternativa. Aun as\u00ed, exige que exista una base probatoria independiente y suficiente.<\/p><\/div><\/details><details class=\"indiem-faq-item\"><summary>\u00bfQu\u00e9 importancia tiene la estrategia de defensa?<\/summary><div class=\"indiem-faq-content\"><p>La decisi\u00f3n de declarar o guardar silencio debe formar parte de una estrategia de defensa individualizada.
