IMPORTANT:<\/strong> This article describes a historic IN DIEM<\/strong> project related to digitization and electronic signatures, in accordance with the regulatory framework in effect at the time of its publication. Currently, any matter concerning electronic signatures, electronic identification, trusted electronic services, process digitization, or e-government<\/strong> must be reviewed on a case-by-case basis, in accordance with the eIDAS Regulation<\/strong><\/a>, the Law 6\/2020, of November 11<\/strong><\/a>, the Law 39\/2015<\/strong><\/a>, and Law 40\/2015<\/strong><\/a>, Law 34\/2002<\/strong><\/a> and current regulations regarding digital identity and trust services. <\/em><\/p>\n\n

This post provides, for informational and historical purposes, an overview of the development of the Advanced 3.0 Project on Digitization and Electronic Signatures<\/strong>, led by IN DIEM<\/strong>. Its content should be read in the context of the technological and regulatory landscape at the time of its publication. <\/p>\n\n

Advanced Project 3.0: Digitization and Electronic Signatures at IN DIEM<\/h2>\n\n

The Advanced Electronic Signature Project 3.0<\/strong> aimed to apply innovations in the implementation of advanced and recognized electronic signatures<\/strong> in IN DIEM<\/strong>\u2019s internal processes.<\/p>\n\n

The purpose of the project was to strengthen collective solutions for electronic operations and transactions, as well as to improve internal administrative processes, incorporating lessons learned from previous technology projects.<\/p>\n\n

Among its main objectives were reducing costs, streamlining service turnaround times, and implementing digital tools that would enable more efficient, secure, and traceable management.<\/p>\n\n

Digitization of Internal Processes<\/h2>\n\n

The digitization of legal and administrative processes makes it possible to transform tasks that traditionally involved paperwork into electronic procedures that are more streamlined, organized, and secure.<\/p>\n\n

In the legal field, this transformation is particularly relevant when working with contractual documents, communications with clients, authorizations, acceptance of proposals, document management, electronic contracting, and the validation of internal procedures.<\/p>\n\n

The Advanced Project 3.0 was part of IN DIEM\u2019s R&D&I<\/strong> strategy in the field of information and communication technologies. The experience gained and the results achieved were made available to the firm\u2019s clients as part of an early commitment to legal innovation. <\/p>\n\n

Advanced and Qualified Electronic Signatures and Trust Services<\/h2>\n\n

At the time the project was published, the legal basis for these processes was linked to the regulations then in force regarding electronic signatures, electronic access to public services, the information society, electronic national identification cards, and related implementing regulations.<\/p>\n\n

Among the historically significant laws were the former Law 59\/2003 on electronic signatures<\/strong>, Law 11\/2007, on citizens\u2019 electronic access to public services<\/strong>, Law 34\/2002 on information society services and electronic commerce,<\/strong> and Royal Decree 1553\/2005<\/strong> regarding the National Identity Card and its electronic signature certificates.<\/p>\n\n

Currently, the regulatory framework must be analyzed in accordance with the eIDAS Regulation<\/strong>, Law 6\/2020<\/strong> governing certain aspects of trusted electronic services, Law 39\/2015<\/strong>, Law 40\/2015<\/strong>, and current regulations on electronic identification, electronic signatures, digital administration, and trusted services.<\/p>\n\n

Legal and Technological Value of the Electronic Signature<\/h2>\n\n

Electronic signatures play an essential role in the digital transformation of businesses, professional firms, and government agencies, as they ensure the security, authenticity, and integrity of electronic documents and communications.<\/p>\n\n

Proper implementation requires evaluating not only the technological tool, but also the type of signature used, the level of identification required, the probative value of the document, the consent of the parties, the preservation of evidence, and the traceability of the process.<\/p>\n\n
