IMPORTANT:<\/strong> This article analyzes a case decided in accordance with the applicable legal and case law framework at the time of its publication. Currently, permanent disability must be analyzed in accordance with the Consolidated Text of the General Social Security Law<\/strong><\/a>, approved by Royal Legislative Decree 8\/2015<\/strong><\/a>, specifically Articles 193<\/strong><\/a> and 194<\/strong><\/a>, as well as in accordance with the regulations applicable to self-employed workers. Any claim regarding permanent disability, financial benefits, RETA contributions, or refunds of contributions must be reviewed in accordance with the regulations and case law in effect at the time of the specific case. <\/em><\/p>\n\n

IN DIEM Abogados<\/strong> secured a favorable ruling in a case involving the total permanent disability<\/strong> of a self-employed worker covered by the Special Social Security System for Self-Employed Workers, known as RETA<\/strong>.<\/p>\n\n

The case was particularly significant because the status of self-employed worker could not, on its own, be used as a basis for denying recognition of permanent disability. The Labor Chamber of the TSJA overturns the lower court\u2019s ruling and recognizes that the status of self-employed worker under the RETA system does not constitute an obstacle or limitation to the full recognition of a permanent disability classified as total<\/strong>, and one\u2019s status as a self-employed or non-dependent worker cannot be used to automatically infer an inability to self-organize one\u2019s work.<\/p>\n\n

Furthermore, following this, IN DIEM\u2019s<\/strong> legal department obtained a favorable ruling from the TGSS, which agreed, on the one hand, to apply the benefits retroactively and, on the other hand, to refund all RETA contributions paid by the worker from the date her disability was recognized by the TSJA.<\/p>\n\n

Recognition of Total Permanent Disability for Self-Employed Workers<\/h2>\n\n

Total permanent disability<\/strong> is defined as the inability to perform one\u2019s usual occupation, even if the affected person retains the ability to perform other activities. In the case of self-employed workers, the assessment can be particularly complex, because their professional activity typically involves a degree of self-organization, direct management of the business, and practical adaptation of tasks. <\/p>\n\n

However, this ability to organize one\u2019s work does not automatically mean that a self-employed worker retains sufficient work capacity. The assessment must be based on actual limitations, the specific demands of the worker\u2019s usual activities, and the actual impact of the medical conditions or aftereffects on professional performance. <\/p>\n\n

Therefore, self-employed status does not preclude the recognition of a permanent disability. What matters is determining whether, based on the work performed and the documented limitations, the person can continue to carry out their usual profession with a minimum level of performance, efficiency, and safety. <\/p>\n\n

The Importance of Assessing Actual Professional Activity<\/h2>\n\n

In proceedings involving permanent disability, it is not sufficient to analyze only the formal description of the activity. It is necessary to assess the actual tasks that make up the usual occupation, the physical or mental demands of the job, the need to travel, the number of hours worked, functional autonomy, interactions with clients, administrative duties, and the specific conditions under which the activity is performed. <\/p>\n\n

For self-employed individuals, this assessment can be decisive. Many self-employed activities combine managerial tasks with hands-on, commercial, technical, or direct-service tasks. Therefore, incapacity must be evaluated in relation to the full range of functions that make up the professional activity, and not merely based on an abstract concept of self-organization. <\/p>\n\n

A proper defense must demonstrate how medical conditions or limitations affect the person\u2019s usual activities and why those limitations prevent the person from continuing to perform those activities under reasonable conditions.<\/p>\n\n

Economic Effects, Retroactivity, and RETA Contributions<\/h2>\n\n

In addition to the court\u2019s recognition of total permanent disability, the case had a second significant outcome: the issuance of a favorable decision by the General Treasury of Social Security<\/strong> regarding benefit entitlements and the refund of contributions.<\/p>\n\n

According to the published ruling, it was agreed that the benefits would be applied retroactively<\/strong> and that the RETA contributions paid by the worker would be refunded, effective from the date on which the TSJA recognized her disability.<\/p>\n\n
