The law is no stranger to the exchange of electronic data<\/strong>, especially when it affects legal and commercial transactions, which were experiencing steady growth. In this context, the use of digital media raised the need for secure technological and legal solutions that are compatible with the European regulatory framework and capable of building trust in electronic transactions. <\/p>\n\n

At that time, the electronic signature<\/strong> emerged as a particularly important tool for strengthening the legal certainty of transactions conducted remotely. Its usefulness was not limited to replacing a handwritten signature; rather, it made it possible to link specific electronic acts to a person, an entity, or an identification system. <\/p>\n\n

In this context, electronic contracting, digital communications, document exchange, and online commercial transactions required mechanisms to verify the authenticity<\/strong>, integrity<\/strong>, and preservation of information.<\/p>\n\n

The Context of E-Commerce and Electronic Signatures<\/h2>\n\n

The rise of e-commerce<\/strong> changed the way businesses, professionals, and consumers interacted. Contracting no longer relied exclusively on paper documents but came to be conducted through web forms, emails, digital platforms, online payment systems, and other technological means. <\/p>\n\n

This transformation offered significant practical advantages: speed, cost savings, ease of access, and the ability to enter into contracts without being physically present. However, it also raised legal questions regarding the identification of the parties, proof of consent, and the retention of electronic documents. <\/p>\n\n

That is precisely why the European legal framework sought to promote the use of electronic documents.<\/p>\n\n

Precisely for this reason, the European legal framework sought to promote secure technological and legal solutions capable of keeping pace with the growth of electronic legal and commercial transactions.<\/p>\n\n

Legal Framework for Electronic Signatures at the Time of Publication<\/h2>\n\n

The document addressed the study of electronic signatures<\/strong> from the perspective of the laws in force at the time of its publication, in particular, based on Directive 1999\/93\/EC of the European Parliament and of the Council, dated December 13, 1999<\/strong>, which established a Community framework for electronic signatures.<\/p>\n\n

In that context, European regulations sought to promote the use of secure electronic mechanisms that were legally recognized by Member States, with the aim of fostering greater trust in digital communications and e-commerce<\/strong>.<\/p>\n\n

E-commerce and Legal Certainty<\/h2>\n\n

E-commerce<\/strong> was one of the areas in which electronic signatures took on the greatest practical significance. Distance contracting, the exchange of documents, the acceptance of terms and conditions, communications between businesses and consumers, and the provision of online services required tools that would make it possible to verify the identity of the parties and the content of the statements made. <\/p>\n\n

In this regard, the legal framework proposed a legally recognized security system to facilitate electronic commerce. The aim was to ensure that digital transactions would not fall outside the scope of the law, but rather could be integrated into the traditional frameworks governing the validity, enforceability, and evidence of legal acts. <\/p>\n\n

An electronic contracting platform was intended to make it possible to verify what was offered, what the user accepted, when the transaction took place, and under what conditions. In this way, technology became a key element in preventing disputes and facilitating subsequent proof. <\/p>\n\n

Evidentiary Value of Electronic Documents<\/h2>\n\n

Electronic documents<\/strong> were becoming increasingly important as a medium for rights, obligations, communications, and transactions. The main legal issue was determining how their authenticity, integrity, and date of issuance or receipt could be proven. <\/p>\n\n

In a judicial or administrative proceeding, simply providing a paper copy of a digital document was not sufficient. It might be necessary to verify the document\u2019s origin, its content, the absence of alterations, and the relationship between the document and the person who created or signed it. <\/p>\n\n

Electronic signatures, certificates, time-stamping systems, activity logs, and technological evidence could play a significant role in building a case. Their purpose was to enable electronic documents to be evaluated with greater certainty. <\/p>\n\n

Electronic Signatures and Evidence in Legal Proceedings<\/h2>\n\n

The article also referred to the procedural framework for the introduction of evidence set forth in Article 299.2 of the Civil Procedure Act<\/strong>, in conjunction with Articles 382 through 384<\/strong> of the same statute.<\/p>\n\n

These provisions made it possible to take into account means of reproducing speech, sound, and images, as well as tools for archiving, accessing, or reproducing words, data, figures, and mathematical operations performed for accounting or other purposes.<\/p>\n\n

From this perspective, electronic signatures and digital evidence were relevant not only at the time of contracting or communication, but also when it was necessary to subsequently prove the existence, content, or authorship of a particular act.<\/p>\n\n

Practical Issues: Authenticity, Integrity, and Preservation<\/h2>\n\n

The main practical issues related to digital evidence can be grouped into three categories: authenticity<\/strong>, integrity<\/strong>, and preservation<\/strong>.<\/p>\n\n

Authenticity<\/h3>\n\n

Authenticity was related to the ability to identify the origin of a document or communication. In the digital realm, this issue was particularly relevant because a file could be easily copied, forwarded, or manipulated. <\/p>\n\n

Integrity<\/h3>\n\n

Integrity referred to the ability to verify that a document had not been altered since its issuance or signing. In electronic transactions, the alteration of a file, a contract, or a communication could have a decisive impact on the content of the parties\u2019 rights and obligations. <\/p>\n\n

Conservation<\/h3>\n\n

Preserving electronic documents posed different challenges than preserving paper documents. It was not enough simply to store a file; it was necessary to ensure that it could be retrieved, read, and verified in the future. <\/p>\n\n

In addition, the preservation process should make it possible to verify the context in which the document was created, signed, or sent, especially when the document might be needed in a claim, audit, inspection, or legal proceeding.<\/p>\n\n

Legal significance of the subject matter at the time of publication<\/h2>\n\n

The importance of electronic signatures and digital evidence at the time of publication was attributed to the growth of electronic communications and the need to adapt legal practice to new forms of documentation.<\/p>\n\n

E-commerce, e-government, online banking, procurement platforms, and digital communications made it necessary to reevaluate how legally relevant facts were established in a remote environment.<\/p>\n\n

From a doctrinal perspective, the subject was particularly interesting because it brought together technology, civil law, commercial law, procedure, consumer protection, and legal certainty.
