IMPORTANT:<\/strong> This article analyzes a case decided in accordance with the applicable legal and case law framework at the time of its publication. Although the reference to Article 1255 of the Civil Code<\/strong><\/a> remains relevant with regard to freedom of contract, the current regime governing the use of the family home must be analyzed in accordance with Article 96 of the Civil Code<\/strong><\/a>, as amended by Law 8\/2021, of June 2<\/strong><\/a>. <\/em><\/p>\n\n

Family Court No. 26 of Seville<\/strong> ruled on an unusual case involving alternating shared use of the family home<\/strong>, in which it was alleged that the husband temporarily lacked an alternative residence and that the spouses had reached a consensus, as part of divorce proceedings.<\/p>\n\n

The court ruling determined, despite the initial opposition of the Public Prosecutor\u2019s Office, to accept this arrangement as a private legal transaction between the parties<\/strong> in accordance with the provisions of Article 1255 of the Civil Code<\/strong><\/a>; however, it noted that the agreement was not enforceable before the court.<\/p>\n\n
