When the court summons already has a date set

A summary trial usually comes with little notice. The person receives a summons, a notice from the police or the court, or learns that they must appear following a prior proceeding. The first step is not to decide immediately what to say, but to understand what procedure has been initiated.

Police Report, Complaint, and Urgent Court Appearance

The police report may contain essential information: observed facts, statements, documentary evidence, police action, witnesses, reports, measurements, seized items, or circumstances surrounding the incident. The complaint may include a version of the facts that must be verified against documentation, messages, reports, or witness statements.

In a court appearance, the court does not base its decisions on informal conversations. It relies on documents, court records, and the parties’ positions in the proceedings. For this reason, the summons should be reviewed alongside the police report and the complaint whenever possible.

The Law 38/2002 amended the Criminal Procedure Act with regard to the expedited and immediate prosecution of certain crimes, and the Criminal Procedure Act remains the primary procedural framework for these types of proceedings.

Why You Shouldn’t Jump to Conclusions Without Checking the Facts

Appearing in court without preparing your case can lead to hasty decisions: testifying without having your story straight, agreeing to a settlement without weighing the consequences, failing to provide useful documentation, or failing to distinguish between defense, negotiation, and litigation strategy.

Emergency assistance in a fast-track trial should focus on reviewing the summons, reconstructing the events, identifying available evidence, and explaining to the client what may be at stake—without promising an acquittal, dismissal, reduced sentence, or favorable outcome.

Common Offenses in a Summary Trial

Expedited trials may involve various criminal offenses, although not every urgent criminal matter is handled through this process. The analysis must be based on the document received, not on assumptions.

Blood Alcohol Content, Driving Without a License, and Traffic Safety

Cases involving blood alcohol content, driving without a license, refusal to submit to testing, or incidents related to traffic safety typically require a careful review of the police report. Measurements, the circumstances of the stop, vehicle documentation, prior history, and potential consequences must all be analyzed.

It should not be automatically assumed that every blood alcohol level results in a specific consequence, nor that every defense will allow the driver to retain their driver’s license. The assessment will depend on the facts, the evidence, the charges, the defendant’s prior record, and judicial discretion.

Injuries, threats, thefts, and violence

There may also be expedited trials related to injuries, threats, coercion, theft, property damage, or violence. In these cases, medical reports, messages, witness statements, recordings, previous complaints, and the context of the events may be relevant.

When the matter involves a family or marital dispute, it may be necessary to coordinate the strategy with an emergency family law attorney if there are minors, family-related measures, or urgent personal decisions connected to the criminal case.

When there is a history or personal measures in place

A plea agreement may arise during the conversation before or during the court appearance. The problem is reaching such an agreement without fully understanding its implications. The urgency of a fast-track trial does not make a plea agreement an automatic response.

What Does It Mean to Accept a Settlement?

Accepting a settlement may involve acknowledging facts, accepting a classification, or consenting to certain consequences. For this reason, it must be evaluated with legal due diligence, even if the proceeding is urgent.

It should not be assumed that every plea agreement reduces the sentence, is always advisable, or guarantees a favorable outcome. It will depend on the specific case, the charges, the defendant’s criminal history, the evidence, and the legal assessment.

Criminal, financial, and personal consequences

A summary trial can affect fines, civil liability, restrictions, license suspension, criminal record, family relationships, employment status, or personal reputation. The decision should not be based solely on the desire to conclude the proceedings sooner.

The possibility of having one’s license revoked, potential civil liability, or a criminal record must be considered before accepting a procedural position. In some cases, there will be room for negotiation; in others, it will be necessary to pursue a different strategy. There is no one-size-fits-all answer.

Prepare Your Defense Before Appearing in Court

Preparing a defense does not mean coming up with a story on the spot. It means organizing the facts, documentation, and evidence so that the presentation in court is coherent.

Documentation, witnesses, evidence, and account of the events

Before appearing in court, it is advisable to gather the summons, the complaint, the police report (if available), medical reports, other reports, messages, emails, photographs, supporting documents, witness statements, vehicle documentation, contracts, receipts, or any other evidence related to the events.

An effective defense must distinguish between what has been proven, what is debatable, and what requires substantiation. It must also assess what each person can testify to and which documents should be submitted or withheld depending on the stage of the proceedings.

Distinguishing Between Defense, Negotiation, and Statement

Defending one’s case does not always mean making a lengthy statement. Negotiating does not always mean agreeing. And appearing in court does not obligate one to make a decision without legal counsel. The strategy must define what should be said, what should be documented, and what risks are involved in each course of action.
