Legal Framework: As Established by the Civil Code

The legal framework supporting the adoption of adults is explicitly outlined in Articles 175 and following of the Spanish Civil Code.

This regulation recognizes the uniqueness of establishing filial bonds with individuals who have already reached full legal capacity, differing substantially from the procedure provided for the adoption of minors. In this context, the mandatory intervention of social services and the performance of comprehensive psychological assessments are dispensed with. This distinction lies in the legal presumption that the adoptee, being of legal age, possesses the maturity and discernment necessary to understand and freely consent to the creation of a filial bond with another person.

The law places trust in the autonomy of the adult’s will, considering that their decision to establish this filial bond responds to an informed and conscious choice, without the need for the guardianship and additional guarantees required in protecting the rights and interests of minors.

Requirements for the Adoption of Adults

Although simpler than the adoption process for minors, this institution is also subject to certain essential requirements:

  • The adoptee must be of legal age. This is the starting point, as it specifically involves formalizing a relationship with a legally capable person.
  • Free consent of both parties. Both the adopter and the adoptee must give their consent expressly before the judicial authority, without external pressure.
  • Minimum age of the adopter. The law requires that the adopter be at least 25 years old.
  • Appropriate age difference. A generational difference of at least 16 years between adopter and adoptee is necessary, maintaining the coherence of the parental relationship.
  • Prior cohabitation in certain cases. If the adoptee is an emancipated minor or an adult who has lived stably for at least one year with the adopter, Article 175.2 of the Civil Code allows this cohabitation to be taken into account as a basis for adoption.
  • Legitimate motivation. Although no specific cause is required, the judge may assess the reasons driving the adoption to prevent possible fraud or interests unrelated to the recognition of a genuine emotional bond.

Legal Procedure

The adoption of an adult is initiated by filing a petition with the court of first instance in the place of residence of the adopter or the adoptee. It must be accompanied by documentation proving compliance with legal requirements: birth certificates, national identity documents, and where applicable, proof of cohabitation.

If everything is in order, the judge will issue an Order approving the adoption and making it fully valid.

  • Creation of a full filiation relationship. Adoption creates between the parties a family bond with legal effects comparable to those of natural filiation: maintenance obligations, inheritance rights, etc.
  • Modification or termination of prior bonds. Generally, adoption implies the termination of legal ties with the biological family, although in the case of adults some type of bond may be maintained, especially in succession matters, if the judge so decides.
  • Change of surnames. The adoptee may acquire the surnames of the adopter, in accordance with general filiation rules, which also has implications in terms of civil identity.
