IMPORTANT: This article analyzes a successful case resolved in accordance with the administrative, regulatory, and disciplinary framework in effect at the time of its publication. Currently, any disciplinary proceeding in sports must be reviewed based on the specific case, current case law, and Law 19/2007, of July 11,, against violence, racism, xenophobia, and intolerance in sports, and Royal Decree 203/2010, of February 26, which approves its implementing regulations.

IN DIEM Abogados secures a favorable administrative ruling for our client in disciplinary proceedings initiated for “sports violence,” in accordance with the provisions of Law 19/2007, of July 11, following a complaint filed by the Local Police during a soccer match at the Sevilla F.C. stadium .

In particular, the Government Delegation in Seville accepted our argument that a broad application of the violations defined in that law was not feasible and, consequently, withdrew the charge of a serious offense that could have resulted in a fine of up to 60,000.00 €, in addition to other ancillary penalties established in the aforementioned regulations. The Government Delegation in Seville therefore acknowledged that the serious offense did not apply to the alleged facts.
