Planning Your Estate to Avoid Future Conflicts

Estate planning allows you to organize the transfer of your assets, reduce family conflicts, plan for tax liabilities, protect certain heirs, and make decisions in advance that might otherwise cause uncertainty after your death.

In matters of inheritance, it is not enough to simply know that a will exists. It is necessary to assess the composition of the estate, the statutory shares, any bequests, prior gifts, real estate, family businesses, debts, encumbrances, tax residency, and applicable regional regulations.

Planning is particularly important in cases involving family-owned businesses, multiple heirs, assets located in different autonomous communities, international assets, complex family situations, or a desire to structure succession based on tax and estate planning considerations.

Inheritance, Taxation, and Family Businesses

Inheritance tax can vary significantly depending on the autonomous community, the family relationship, pre-existing assets, the nature of the assets, and the availability of applicable deductions or tax credits.

In addition, when the estate includes a family business, it is advisable to review the corporate structure, the continuity of the business, management succession, the transfer of ownership interests, and the possible need for family agreements.

Coordination among civil, criminal, and commercial law enables more sound decision-making and helps prevent future conflicts among heirs, partners, or family branches.
