Law is not oblivious to the exchange of electronic data, especially when it affects legal and commercial transactions, which are experiencing unstoppable growth. In this regard, legally, there are secure and compatible technological and legal solutions, legally enshrined by the EU and all its member countries.

This document delves into Electronic Signatures from the perspective of current legislation that European Administrations seek to promote, particularly Directive 1999/93/EC of the European Parliament and of the Council of 13 December 1999; developing the essential concepts of electronic signature and advanced electronic signature, within a legal framework defined as secure communication.

Likewise, reference is also made to E-commerce which – ultimately – is the beneficiary of the legally recognized security system proposed by the legal framework and the procedural channel for introducing evidence as stipulated in Article 299.2 of the LEC, in relation to Articles 382 to 384 of the same legal text.
