Free Procedural Forms from the General Council of the Judiciary for citizens.
Area: Procedural Law
Date: March 2016

The Charter of Citizens’ Rights before Justice, in its Article 8, stipulates that citizens have the right to free access to the necessary forms for exercising their rights before the Courts when the intervention of a lawyer and solicitor is not mandatory.

In this regard, the Permanent Commission of the General Council of the Judiciary, by means of an Agreement dated December 22, 2015 (published in the BOE on January 28, 2016), has approved the standardized forms or models for intervention in proceedings without a lawyer or solicitor.

These forms were provided for in the CIVIL PROCEDURE LAW, through the reform set out in Law 42/2015, of October 5, and in LAW 15/2015, of July 2, on VOLUNTARY JURISDICTION

We provide the BOE with the documents that include the following (standardized models / forms):

1.- Request for Conciliation (Article 141.1 of Law 15/2015, of July 2, on Voluntary Jurisdiction)

2.- Request for Voluntary Jurisdiction Proceeding (Article 14.3 of Law 15/2015, of July 2, on Voluntary Jurisdiction)

3.- Claim in Oral Proceedings.

4.- Reply to the Claim in Oral Proceedings

5.- Model for Payment Order Proceedings

6.- Payment Order Proceedings (Claim for common expenses of Homeowners’ Associations)
