Seville Family Court No. 26 has ruled on an unusual case concerning the alternating shared use of the home, where the husband’s provisional lack of an alternative residence and the consensus of both spouses were alleged within divorce proceedings.

The judicial ruling, despite the initial opposition of the Public Prosecutor’s Office, agrees to accept said arrangement as a private legal transaction between the parties in accordance with Article 1.255 of the Civil Code; however, it warns that it will have no effect for enforcement purposes before the Court.
