Commercial Agency. Colombia and Spain.

Commercial Agency. Colombia and Spain. Comparative Notes. European Union. Termination of the Contract. Commercial relations between Colombia and Spain are particularly strong and, quite often, are formalised through commercial agreements such as a Commercial Agency. The legal systems of Colombia and Spain have points in common, as well as protective conditions in favour of the Agent; however, there are differences between them that should be taken into account. This publication aims to provide a practical approach to some of the most relevant differentiating elements when applying and choosing the applicable regulations, such as compensation rights upon termination of the agency contract. Agency Agreement. Spanish Regulations. In our commercial legal system, the Agency Agreement lacks comprehensive regulation within the Commercial Code. Instead, Law 12/1992, of 27 May, on Agency Agreements (hereinafter, the LCA), provides the aforementioned agreement with its own detailed regulation and legal regime, defining the Agency Agreement in its...

Child Support and Change of Custody of a Minor Without Court Order. Case Law Study.

Case: Change of custody of a minor by mutual agreement without court order. On occasion, for multiple reasons, the custody of a minor, whether temporary or permanent, may be modified de facto by the parents without having previously initiated a judicial modification of measures proceeding. In these cases, a minor begins to reside with the non-custodial parent. Let us consider an example: Mr. Pablo and Ms. Paula divorce, having two minor children from the marriage. In the mutual consent divorce proceeding, the regulatory agreement is approved, stipulating that custody will be attributed exclusively to Ms. Paula, establishing the corresponding visitation regime in favor of the father, Mr. Pablo, who must pay the amount of 500 euros each month (250 for each child) as child support. Subsequently, for the benefit of the minor, the parents agree to modify the custody arrangement, with the minor moving to reside indefinitely with the...

Success Stories: Grants. Eligible Preliminary Technical Projects. Administrative Litigation Lawyers.

Success Stories: Grants. Eligible Preliminary Technical Projects. Administrative Litigation Lawyers. IN DIEM Lawyers obtains a favorable ruling from the TSJA, which declares that preliminary technical projects for facility adaptation to prove the technical and economic viability of a project are eligible for grants and, therefore, cannot be denied for being included within the justified economic items. Issues arising in relation to “preliminary projects” often generate conflict, as regulations generally state that investments cannot begin until the applicant is notified in writing that the project meets the conditions established in the regulatory bases to be considered eligible for incentives (as seen in the Order of January 18, 2012, art 3.1.c). In particular, the ruling of the HIGH COURT OF JUSTICE OF ANDALUSIA (SEVILLE SEAT), ADMINISTRATIVE LITIGATION CHAMBER, FIRST SECTION, in Appeal 476/2017, issued on December 19, 2017, upholds the corresponding appeal and annuls the contested administrative resolution of the Innovation and...

IN DIEM Administrative Law Attorneys. Challenge to Tender Specifications. Tendering. Case Studies.

Case Studies: Challenge to Tender Specifications. Tendering. IN DIEM Lawyers obtains a favorable resolution in a procedure challenging Tender Specifications. The tender specifications for the award of the DOCUMENTATION DEPOSIT AND CUSTODY SERVICE of the Andalusian Agency for Environment and Water were appealed. The fundamental reason was the infringement of competition, by establishing a geographical limitation on potential suppliers. The technical specifications of the tender document required that the contractor’s facilities be located within a 25 km radius of the Central Services of the Environment Agency. This limited the number of suppliers participating in the tender, which implied a restriction on the options for awarding such services. To this end, the IN DIEM Administrative Law Attorneys Department developed the following arguments in its appeals: Free competition, affecting the public interest, the appealing bidder (our client), and private interest; Constitutional principles of legality and legal certainty. Principles of publicity, transparency, and...
