A company can have a foreign invoice, supplier or customer perfectly identified and still find difficulties when the payment is made using Bitcoin, stablecoins or other cryptoassets. In international payments with cryptocurrencies, the transfer on the blockchain is only one of the pieces: behind it there is still a contract, an economic obligation, two counterparties, a jurisdiction of origin and a jurisdiction of destination and, often, a subsequent conversion to euros or another fiat currency.

This service is integrated within IN DIEM’s cryptocurrency and crypto-asset lawyer area and focuses specifically on cross-border payment transactions. The aim is not to analyse the technology used to transmit value in isolation, but to check that the payment fits with the transaction it aims to satisfy and that there is documentation capable of explaining it coherently before, during and after the transfer.

What should be reviewed before an international cryptocurrency payment

The first question should not be which wallet to use, but what is being paid for and between whom. A charge derived from an export, a provision of services or an international sale must maintain a clear connection with your contract, invoice and other commercial documentation.

Before executing the operation, it may be necessary to analyze, among other aspects:

  • The identity and activity of the companies involved
  • The contract, invoice or financial obligation that gives rise to the payment
  • The country of origin and the country of destination
  • The cryptoasset that is intended to be used and the way to determine its economic equivalence
  • The wallets and service providers that will be involved
  • Documentation relating to the origin and destination of the funds
  • Regulatory or territorial restrictions that may affect the operation
  • Where applicable, the subsequent conversion of the amount to fiat currency

The use of a crypto-asset as a means of payment does not eliminate the obligations affecting the underlying transaction. If there are restrictions due to the country, the counterparty, the sector or the nature of the goods or services, they should also be considered.

IN DIEM Abogados advises on international payments with cryptocurrencies in compliance with international regulations and, in particular, the legal framework of the European Union and the applicable provisions of the United States, in accordance with European law. Each transaction requires an assessment of the jurisdictions involved, the counterparties and possible restrictions or sanctions, without the use of cryptoassets allowing the applicable legal prohibitions to be circumvented.

The country of origin and destination can change the analysis

There is no single valid structure for any international transfer. The applicable framework may vary depending on the jurisdictions involved, the provider used and the circumstances of the business relationship. Therefore, when a broker raises its own particularities, it is advisable to study it specifically.

Within this area, IN DIEM specifically addresses, among other cases, cryptocurrency payments between Cuba and Spain and cryptocurrency payments between Cuba and the European Union. These pages analyse the particularities of these specific corridors, without prejudice to the fact that similar transactions may be considered with companies and counterparties located in other countries, whose legal, documentary and compliance structure must be reviewed according to the jurisdictions involved.

Documenting the transaction, not just the transfer

A transaction recorded on the blockchain allows certain technical data to be accredited, but it does not explain its economic cause on its own. For a company, it is relevant to be able to relate the movement of cryptoassets with the documentation that justifies the right to collect or the obligation to pay.

Contracts, invoices, purchase orders, transport or delivery documents, commercial communications and proof of execution can be part of the transaction file. The documentation required will depend on the specific business, but it should make it possible to reconstruct in an understandable way what obligation exists, who satisfies it, what its amount is and why this means of payment has been used.

This preparation becomes more relevant when an exchange, a financial institution or a provider subsequently intervenes to request information on the economic origin of the assets. Compliance in cryptocurrency payments should not be improvised only when a requirement appears.

Source of funds, traceability and compliance controls

In an international operation, different review planes can coexist. It is one thing to prove the economic cause of the payment and another to analyze the route of the cryptoassets, the addresses used and the possible risks associated with the transaction.

There may also be procedures for identifying customers and counterparties, beneficial ownership checks and requests for information related to the origin of the funds. When the transaction has characteristics that require a specific analysis in terms of prevention, IN DIEM can coordinate this review with its anti-money laundering area.

The information provided to the different operators must be consistent. A description of the commercial transaction that does not coincide with the invoices, amounts, counterparties or movements executed can generate new requests for documentation and make the process more difficult.

Crypto exchanges and service providers in business operations

A company should not approach a corporate transaction in the same way as an occasional purchase and sale carried out by an individual. It is necessary to check which entity will actually provide the service, what operation it supports for business customers and what corporate procedures must be completed.

In the European Union, the activity of crypto-asset service providers is subject to the MiCA framework. In Spain, once the transitional regime has ended, it is particularly important to verify the qualification of the provider that is going to provide the service. The European regulations on crypto-asset transfers also add information and traceability obligations in the transactions to which it is applicable.

This page deals with the specific scenario in which crypto assets are used within a cross-border payment. Other issues, such as the regulation of providers, tokens, blockchain projects, Web3, or digital asset-based services, are developed more broadly in the general area of cryptocurrency legal advice.

Receiving the cryptocurrencies may not complete the collection

For many companies, the ultimate economic objective is not to hold cryptoassets. If an invoice is denominated in euros and the customer satisfies it with cryptocurrencies, there may be a second phase: transforming the value received and incorporating it into the company’s ordinary treasury.

The conversion of cryptocurrencies to euros for companies should be considered before receiving the assets when it is foreseeable that it will be necessary. The existence of a wallet with a balance does not in itself guarantee that the corporate conversion process is prepared or that the chosen operator already has all the documentation it will require.

The same applies from the perspective of the payer. If you need to acquire or transfer a certain crypto-asset to satisfy an international obligation, the amount due, the equivalence used, the costs of the transaction, the time of payment and the documentation that allows you to subsequently demonstrate its correct execution must be coordinated.

What happens if the payment has already been made

The query can also arise when the cryptoassets have already been sent or received. In this scenario, the starting point is the existing situation: contract and invoicing, wallets used, transactions executed, counterparty, available documentation and the purpose to be achieved.

If an exchange or provider has requested additional information, it is advisable to first identify what it is reviewing and prepare a response consistent with the documentary reality of the transaction. When the objective is to subsequently convert assets to EUR, it should also be considered which corporate procedures remain pending.

Legal advice on international payments with cryptoassets

IN DIEM may intervene before the transfer or when the operation is already underway. Depending on its characteristics, the assistance may include the review of the contractual relationship, the analysis of counterparties and jurisdictions, the preparation of the documentary file, issues of origin of funds and compliance, the review of the operators that must intervene and the accompaniment of requirements related to the operation.

When an additional technical aspect is necessary, the legal action can be coordinated with professionals specialized in traceability and operations with digital assets. The purpose is to maintain a consistent explanation from the commercial obligation that gives rise to the payment to its receipt and, where appropriate, its final conversion.

In business transactions of significant amounts, preparing this journey before transferring assets allows you to detect in advance which legal, documentary and operational aspects need to be resolved, instead of analysing them separately when the funds are already in motion.

FAQs

Frequently Asked Questions International Legal

Answers to frequently asked questions about international legal services, cross-border operations, corporate law, and global legal advisory.

Can a company pay an international invoice with cryptocurrency?

The use of crypto-assets as a means of payment may be considered if it is compatible with the contractual relationship and the rules applicable to the transaction. The agreed conditions, the jurisdictions involved, the counterparties and the way in which the payment will be documented should be reviewed.

Can a company receive international payments in stablecoins?

The use of stablecoins can be part of a business operation, but the specific asset, the suppliers that will be involved, the documentation of the underlying business, and the applicable regulatory framework must be analyzed. Not all stablecoins or structures have the same legal characteristics.

What documents may be required to justify an international payment in cryptocurrencies?

It will depend on the business, although contracts, invoices, purchase orders, delivery or service provision documentation, communications between the parties, corporate information and data that allow the amount transferred to be related to the corresponding economic obligation may be relevant.

How do you credit the source of funds for a crypto business payment?

The analysis is not limited to the blockchain. It must be possible to explain the economic cause of the funds, identify the commercial operation that originates them and, when necessary, complement this documentation with information on the transactions and wallets used.

Can an international payment received in cryptocurrencies be converted to euros?

There are providers that offer exchange services between cryptoassets and fiat currency for corporate clients. The specific operation will depend on the provider, the asset, the amount and the identification and compliance procedures required.

Is it necessary to use an authorized exchange?

When crypto-asset services subject to European Union regulation are contracted, it must be verified which entity actually provides the service and its corresponding authorization. In Spain, the transitional MiCA regime ended in 2026.

What happens if the exchange asks for information after receiving the crypto?

The exact content of the request must be analyzed and contrasted with the documentation of the operation. The response should explain in a coherent manner the counterparty, the cause of the payment, the amount, the economic origin of the funds and any other circumstances requested.

What regulations must be respected when making international payments with cryptocurrencies?

Transactions must comply with applicable international regulations and, in particular, with European Union legislation and relevant US provisions, taking into account the European legal framework. IN DIEM Abogados considers these requirements in the legal analysis of each transaction, paying special attention to international restrictions, counterparties and regulatory compliance.

Should I review the transaction before receiving a large payment in cryptocurrency?

In significant transactions, the pre-review makes it possible to check the commercial documentation, the payment structure, the suppliers that will intervene and the planned form of conversion or subsequent disposal of the assets. This makes it easier for all the phases to respond to the same business and document logic.
