Labor Category: Permanent Disability The Social Chamber of the TSJA reversed the first instance ruling and recognized that the status of self-employed worker under the RETA regime does not constitute an obstacle or limitation to the full recognition of Permanent Disability at the total degree, and that their status as self-employed or non-dependent worker cannot be used to automatically deduce the capacity for self-organization of work. Furthermore, following this, IN DIEM’s legal services obtained a favorable ruling from the TGSS, establishing, on the one hand, the retroactivity of benefit effects, as well as the refund of all RETA contributions paid by the worker from the date of disability status recognized by the TSJA.

Laboral Categoría: Incapacidad Permanente La Sala de lo Social del TSJA, revoca sentencia de primera instancia, y reconoce que la condición de trabajador autónomo en el régimen del RETA no se configura como obstáculo o límite para el pleno reconocimiento de una Incapacidad Permanente en el grado de total, no pudiéndose esgrimir su condición de autónomo o trabajador no dependiente para deducir de forma automática la capacidad de auto-organización del trabajo. Así mismo, tras ello, los servicios legales de IN DIEM han obtenido resolución favorable del TGSS acordándose, de un lado, la retroactividad del los efectos prestacionales, así como también la devolución de todas las cuotas del RETA con abonadas por la trabajadora desde la fecha de situación de incapacidad reconocida por el TSJA.

The present case stems from an inspection report issued due to a work accident.
