On occasion, for multiple reasons, the custody of a minor, whether temporary or permanent, may be modified de facto by the parents without having previously initiated a judicial modification of measures proceeding. In these cases, a minor begins to reside with the non-custodial parent. Let us consider an example: Mr. Pablo and Ms. Paula divorce, having two minor children from the marriage.   Supuesto: Cambio de custodia de un menor por mutuo acuerdo sin sentencia judicial. En ocasiones, por múltiples razones, la custodia de un menor de forma temporal o definitiva puede ser de facto modificada por los progenitores, sin que previamente hayan acudido a un procedimiento judicial de modificación de medidas. En estos caso, un menor pasa a convivir con el progenitor no custodio. Pongamos un ejemplo: El Sr. Pablo y la Sra. Paula se divorcian, habiendo dos hijos menores fruto del matrimonio. The tender specifications for the award of the DOCUMENTATION DEPOSIT AND CUSTODY SERVICE of the Andalusian Agency for Environment and Water were appealed. The fundamental reason was the infringement of competition, by establishing a geographical limitation on potential suppliers. The technical specifications of the tender document required that the contractor’s facilities be located within a 25 km radius of the Central Services of the Environment Agency. This limited the number of suppliers participating in the tender, which implied a restriction on the options for awarding such services. Casos de Éxito: Impugnación de bases de Concurso. Licitación. Abogados IN DIEM, obtiene resolución favorable en procedimiento de impugnación de Bases de Concurso. Se recurrieron las  bases del concurso para la adjudicación del SERVICIO DE DEPÓSITO y CUSTODIA DE DOCUMENTACIÓN de la Agencia de Medio Ambiente y Agua de Andalucía. El motivo fundamental fue la infracción de la competencia, al establecer una limitación geográfica a los potenciales proveedores. Las prescripciones técnicas del pliego exigían que las instalaciones del contratista deberían estar ubicadas dentro de un radio de 25 km de los Servicios Centrales de la Agencia de Medio Ambiente. Esto suponía una limitación de proveedores en la participacion del concurso. Lo que implicaba una limitación en la opción de la adjudicación de tales servicios.
